Terms of Use

This end-user license agreement (“Agreement” or “EULA”) describes your rights and obligations when using the Arivo service (“We”, “Our”, “Service”, “Site”) and license files. This agreement applies to all users of services (collectively or individually, “you”, “your”, “user”).

Acceptance of Terms

This license agreement is a legal document between you and Arivo and governs your use of the services. The purpose of this license agreement is to enable you to use the services provided by Arivo and receive user files. This license agreement comes into force from the date when you first get access to the service or otherwise use the services (“Start Date”). By using the services, you acknowledge that you have read the Arivo privacy policy.

If you accept this license agreement on behalf of a company or other legal entity, then you confirm that you have written permission and authority to speak on behalf of the company and agree to these terms. If you do not have such authority, then you cannot accept this agreement and use the Arivo services and user files.

By registering on the site or otherwise using the services of Arivo, you agree to abide by all the terms of this agreement and all legal obligations between you and Arivo. The fact of using Arivo user files or services is your acceptance of the license agreement, if you do not agree with these conditions, then do not register on the site, do not download, do not use user files and do not use Arivo services.

Accounts and registration

In order to access the services and user files, you must register an account through the Arivo website (www.arivo.net). An account must be registered for only one (1) individual (“Registered User”), provided that accounts registered and owned by the company or other legal entity can be used exclusively for the purposes of exercising the rights and obligations of such a person under this agreement. Under no circumstances can you intentionally or through negligence or inaction allow others to access your account unless expressly authorized by Arivo in writing. You are prohibited from transferring your account, any user files or credits (file downloading points) to another natural or legal person, unless otherwise expressly authorized by Arivo.

When registering for an account, you must provide Arivo with a valid email address and password that will be recorded in the Arivo database. You agree that you will always provide true, accurate, current and complete information in accordance with the request when registering an account and maintain and update this registration information so that it remains true, accurate, current and complete. You are solely responsible for maintaining the confidentiality of your account and password, as well as for restricting access to any computer or device that you use to access Arivo services. You are solely responsible for all activities that occur under your account. Arivo reserves the right to refuse to provide services, suspend or terminate accounts, delete or edit any data, remove access to user files or cancel orders at its discretion if you provide registration information that is false, inaccurate, irrelevant or incomplete . Arivo has the right to transfer your registration information to its partners, affiliates and third parties only as necessary to manage the Arivo business (for example, to process orders and payments, etc.), without notifying you about it.

Users Content

When working with the Arivo service, users can download specific user content for display to other users and an unlimited number of people. You are the owner of user-generated content all the time, and Arivo does not claim ownership of your content.

You are solely and solely responsible for ensuring that any content uploaded by you complies with all applicable laws, third party rights, including but not limited to any intellectual property rights, privacy rights, and public use rights. You agree that any information included in your user content may be available for use by other people, including the Arivo service. Our services are not intended for children under 18 years of age. Persons under the age of 18 are prohibited from registering or using the services. ARIVO DOES NOT WARRANTY THE COMPLETENESS AND ACCURACY OF THE SERVICES OR INFORMATION CONTAINED IN THE CONDITIONS. DOES NOT PROVIDE ANY WARRANTY THAT THE SERVICES WILL BE AVAILABLE TO YOU ALWAYS OR AS FAST AS THEY WILL BE PROVIDED TO YOU. THE INFORMATION CONTAINED IN THE SERVICES MAY BE INCORRECT, MAY CONTAIN ERRORS OR OUTDOOR, USER FILES MAY NOT SUPPORT YOUR SOFTWARE IS IMMEDIATELY IMPORTANT. CUSTOM FILES MAY CONTAIN ERRORS OR LOOK AT OTHERWISE DESCRIBED IN THE FILE INFORMATION. ARIVO SERVICES AND USER FILES ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY. ARIVO IS NOT OBLIGED TO CORRECT AN ERRORS, TO PROVIDE UPDATES OR OTHERWISE PROVIDE SUPPORT OF SERVICES. ARIVO RESERVES THE RIGHT TO ADD, CHANGE OR DELETE ITS SERVICES AT ANY TIME. ARIVO PROHIBITS TO USE THE SERVICES AND CUSTOM FILES FOR ANY ILLEGAL PURPOSES, DOES NOT RESPONSIBILITY FOR ANY DIRECT, INDIRECT, ILLEGAL, SPECIAL, INCIDENTAL DAMAGE. ARIVO NOT RESPONSIBLE FOR YOU AND ALL YOUR ACTION with the service and user files, do not have pay moral or material damage resulting from the use or user files, do not compensate for any loss or COURT COSTS, NOT PARTICIPATING IN THE COURTS ON YOUR SIDE WHEN MAKING LEGAL CLAIMS TO YOU FROM THIRD PARTIES.

Dispute Resolution

If a conflict or misunderstanding arises, you agree to try to solve the problem peacefully by involving Arivo in a constructive dialogue. You agree to give Arivo thirty (30) days to answer and resolve your problem before publishing the information in the media, contacting third parties, or requesting legal protection.

This agreement is concluded in accordance with the laws of the Russian Federation and you agree that all litigations will be resolved by the parties in the Russian Federation on the territory of the magistrate of the Perm Territory, the city of Tchaikovsky, except in cases of violation of international laws.

Indemnification

You agree that Arivo or its owners, affiliates, partners have the right to judicial protection of their interests and user files. Arivo can and has full rights to prevent the illegal distribution of files, to seek injunctive relief, as well as by removing content from stores, websites, social networks and any digital or physical media. Arivo has the right to demand and recover from you compensation for the illegal use of services or the use of unlicensed files through the court, by contacting the supervisory authorities, the police or by directly contacting stores and sites that distribute illegal content.

Changes to the conditions

Arivo reserves the right to amend these and other conditions published on the site at any time without prior notice to registered users. You agree that you will independently check for updates on this page. If you object to any change, you must immediately stop using this site and may require Arivo to delete your personal data and block access to your account. Unless otherwise specified, the current rules, licenses and privacy policy apply to all data that Arivo has about users and the entire site.

License Policy

Subject to your payment of the applicable fees and your continued compliance with this agreement, Arivo grants you a limited, non-exclusive, revocable, non-sublicensable, non-transferable license to:

  • Using the service to demonstrate objects in augmented reality.
  • Upload, store and download custom files from the library.
  • Receive video, audio and images using services to showcase your products.

These and other rights are granted to you only when subscribing to a license, and not when selling or downloading user files. A license or other rights cannot be obtained in any other way in accordance with this agreement.

Free license

Free license is intended for individuals or legal entities that have an annual gross income of less than $ 100,000, including attracted investments and all other sources of funds. The license allows the use of services for non-commercial purposes only for one (1) workplace of an individual or up to ten (10) workplaces of a legal entity.

Basic license

Indie license is intended for individuals who have an annual gross income of less than $ 100,000, including attracted investments and all other sources of funds. The license allows the use of services for non-commercial or commercial purposes, for one (1) workplace.

Plus license

Studio license

Studio license is intended for individuals or legal entities with any income. The license allows the use of services for non-commercial or commercial purposes for ten (10) jobs.

Software

All software as a service (SAAS) used in connection with the provision of services is our intellectual property and by third parties, unless it may be necessary to carry out a specific license. Selling, decompiling, reverse engineering, disassembling, bringing such software into a human-readable form is prohibited. You agree that we may update the software without notice, at any time and in our sole discretion, and that this agreement will apply to all updated versions.

Usage of custom files by us

Using the service, you provide Arivo with a worldwide, non-exclusive, free, perpetual, irrevocable, sublicensed right and license to use, reproduce, publicly display, distribute and adapt publicly available user content, for the purposes of developing, distributing, providing, improving and promoting services, our activities and your publicly distributed user content. In addition, you grant Arivo the right to use your name, trademarks and logos, if any, in connection with our use of your public user content.

Demonstration of user files

Users allow the demonstration of their user files on the Internet, acknowledge and agree that their content may be available and can be downloaded from a third-party application or website, through the download API controlled by Arivo. Users also recognize the right and allow an unlimited number of people to use AR / QR codes and links to Arivo pages to demonstrate user files for educational, educational or any other non-commercial purposes.

Free use of user files

Paid use of user files

Subject to obtaining prior permission from us, you can also provide access to your user content to other users for paid file downloads. In this case, you give us the right to provide other users with a non-exclusive, non-publishing and non-transferable, perpetual, worldwide right to use your user content for the purposes and on the conditions specified in our license agreement. Each such purchase of a file license is subject to a license fee paid by other users and Arivo is entitled to a commission fee in accordance with our price list, which we can change at any time, at our sole discretion.

Intellectual Property

Arivo owns all rights, property rights, copyrights and other intellectual property rights and interests, including but not limited to all trademarks, logos, company names, etc. in the Arivo services, sites and files, related software and materials, any documentation and any copies thereof, and retains all such rights to any other products and services, except as expressly provided in this agreement. Under this agreement, no licenses, rights or interests are granted for any patents, trademarks, copyrights, trademarks and Arivo logos. Services are licensed, not sold.

Unless expressly authorized by Arivo, you agree not to sell, license, distribute, copy, modify, use publicly or demonstrate, transfer, publish, edit, adapt, adapt create derivative works or competing products or services, as well as otherwise unfairly use Arivo services, license files or other materials.

You agree not to make any claim, action or litigation against Arivo for infringement of any patents, patent rights or other intellectual property rights. License restrictions

Arivo services are intended solely for advertising, educational and other demonstration purposes, a number of restrictions are imposed on your use of the service to protect our rights and licenses of third parties.

You cannot:

  • Post hateful or hostile content. Use any kind of discrimination or derogatory image of people, religious symbols, countries.
  • Apply services for agitation and propaganda of political parties, candidates for elected positions, publish appeals and political slogans.
  • Use pornographic materials or any image of the naked genitals, anal passages and nipples of the breasts of any gender, except when used for educational, cultural and educational purposes.
  • Display the faces of famous people, logos and brand names, designer items and architectural structures without first obtaining written consent from the owners of the rights to such use.
  • Violate user content licenses, publish user files already in the service without making changes and modifications allowed by the license.
  • Transfer downloaded user files to third parties or publish them freely.

  • Try to reverse engineer, decompile, repeat, copy, or disassemble the services and related materials.
  • To rent, lease or lease services, software and materials.
  • Use the services, user files, software and materials for any illegal purpose.
  • Use the services, user files, software and materials in any way that violates the rights of third parties, including, but not limited to, the intellectual property of Arivo.
  • Use the services, user files, software and materials for any software, content or services that compete with the Arivo service in whole or in part.
  • Use services, user files, software and materials to develop, improve or facilitate the work of any artificial intelligence, develop or improve a neural network.
  • Apply bulk download and use of services, user files, software or materials. Take any action that places an excessive or disproportionate burden on services or related systems or servers.
  • Try to disrupt the operation of the software or gain access to prohibited sections of the site and the database, to deceive and cheat in order to illegally modify your account data or the data of other users.
  • Use services or any information to bypass the login architecture or provide any other means through which services can be accessed and used by third parties.
  • Publish your account login information in the public domain, sell or transfer it to third parties for temporary use.
  • Use someone else’s payment information without written permission from the account holder.
  • Try to remove the mention of the use of Arivo services, logos and links to the site, if this is not expressly permitted in your license.

Assignment of rights

You must not, without the prior written consent of Raw Catalog, assign, transfer, charge, subcontract, license or otherwise manage all or any of your rights and obligations in accordance with this license agreement. Arivo may at any time transfer, transfer, charge, enter into a subcontract, or in any other way dispose of all or any of its rights and obligations under this license agreement without prior notice.

Non-partnership condition

This agreement is not and should not be construed as a partnership or joint venture between Arivo and you. None of the parties to this agreement has the right to bind or bind the other party in any way, and nothing contained in this document gives or is intended to provide any rights to third parties.

License Completion

The validity of this license agreement and the license provided in this document must begin from the start date, as defined above, and will be valid until its termination. You can cancel your license at any time by ceasing to use the services. In the event that you do not comply with the terms of the agreement and if the violation is not eliminated within thirty (30) days from the date of notification, Arivo has the right to terminate this agreement ahead of schedule. In the event of a material violation on your part of any provision of this agreement, Arivo may terminate the agreement without prior notice. Failure to pay for services or violation of any license restrictions is a material violation of this agreement.

Termination of the license agreement will result in deactivation of your account and termination of your license. Upon termination of this agreement, you must immediately stop using the services and destroy all copies of the files at your disposal, as well as any information received as a result of receiving the services. You will not receive a refund for the remaining subscription time or purchased loans.

Payments Policy

After you have ordered and paid for services, you cannot refuse the services ordered, paid credits, or demand a refund. You agree to fully pay any fees for services purchased through your account with any payment method accepted by Arivo. You are responsible for providing Arivo with valid payment information to ensure payment security. Arivo reserves the right to cancel any services ordered if there are insufficient funds in your account or the payment information provided by you is invalid. Payments can be processed in collaboration with third-party payment service providers.

Payment Process

At the time of the first payment, you give permission to Arivo and payment service providers to withdraw funds from your account for the use of services and the purchase of additional credits. Arivo reserves the right at any time, without prior notice, to change tariffs, the cost of credits, payment terms or any parameters for the provision of services in the tariff plans, provided that the changes do not affect the parameters of the services already purchased and paid in full. You are solely responsible for revising the parameters of services and licenses. If the changes are unacceptable to you, then you can stop using the service.

You bear all responsibility for the independent payment of all taxes and fees (including taxes and fees that Arivo and payment service providers are not required to collect), as well as for all expenses for hardware, software, Internet services and other expenses associated with the provision of access to the Arivo service.

YOU GUARANTEE THAT YOU HAVE THE FULL LEGAL RIGHT TO USE A PAYMENT ACCOUNT AND ANY BANK ACCOUNT OR CREDIT CARD WHICH YOU USE FOR PAYING SERVICES.

Prices and Credits

Service fees (tariff plans) and the corresponding subscription periods are indicated on the site’s page Subscriptions. Payment of a subscription provides you credits. “Credits” are digital resources that can be used to obtain paid files available in the library. Credits are not your personal property and have no value outside the service. You can also purchase additional credits for use in the service. The cost of credits is indicated on the page Credits.

ALL SERVICE SUBSCRIPTIONS ARE PAYED BY PAYMENT AND DO NOT RETURN IN WHOLE OR PARTIAL VIEW. CREDITS PURCHASED DO NOT BE YOUR PROPERTY AND REFUNDS ARE NOT SUBJECT TO BE POSSIBLE.

Audit

You agree to keep accurate records related to your use of services and license files, including, but not limited to, financial documents confirming your right to participate in a particular tariff plan. Arivo has the right to verify these records. The audit will be conducted during business hours and upon prior notice. If you exceed the volume of your license, you will need to pay the cost of the audit and select a new license to continue using the service.
